Dear Senator Brown:
I thought that I should fill you in on some of the facts behind the scenes on why no one wants anything to do with this case. First of all, it is in the DOJ computer; I am not sure exactly what is says, but more than a dozen DOJ employees had brought it up on the screen and our conversion suddenly got very cold. They would have to ask their boss or adviser on what to say; then I was given some kind of an off the wall excuse, “the brush-off”. No two government employees ever came up with the same excuse.

I believe it was the FBI Cincinnati office that put the red flag in the computer. I had even tried the U.S. Attorney, Cincinnati office; again it was always the same, when they pulled it up on the screen they did not want anything to do with me. They would not even let me make an appointment once they found out this case was on the black list. You could send this case to the U.S Attorney, Cincinnati office; I doubt that they would do anything either, too many politics.

Off the subject, I came across an article yesterday on a judge from northern Ohio that got sentenced to five years in prison for judicial corruption. (See attached news article and USDOJ News Release.) They do actually go after criminal judges once in a while. I suppose he didn’t have any friends in high places or maybe it just went public.

There were a couple of paragraphs in the News Letter that I found quite interesting; I don’t think you will find any officials in southern Ohio making this statement, “but I thought it was well spoken”. You could just about change the names and county and have the same case…

While there is no pleasure in arresting sitting judges, a corrupt commissioner and others, there is satisfaction in knowing the people of Cuyahoga County will now see what justice looks like, Figliuzzi said.

Regardless of one’s status or position, when a public official elects to betray the public’s trust for personal gain, the very core of how and why our system of government operates is immediately and negatively impacted,” Gonzales said. “Therefore, in partnership with the U.S. Attorney’s Office and the FBI, the IRS Criminal Investigation Division gives priority to investigations involving the alleged breach of the public trust by government officials at any level.

Back to the case, I included a letter titled “Politics”, this explains part of the reason this case is on the black list. I sent this letter to several agencies, never got a reply on this one either. Kind of like the “Fast and Furious, Project Gun Walker”; they would like this one to just disappear too.

The theft of my personal property is water under the bridge; you can’t go back in time and start all over. Fortunately, our constitutions and laws of the United States have a solution to this kind of problem, called, “Legal Rights and Due Process of Law”. What a concept! On pages 7, 8, and 9 of the letter labeled “Politics” you will find a synopsis of the four cases that were filed and the awards that I am entitled.

The case was rigged from the very beginning; there was no such thing a “Procedural Due Process” (Due process is the legal principle that the government must respect all of the legal rights that are owed to a person according to the law. Due process holds the government subservient to the law of the land protecting individual persons from the state. When a government harms a person without following the exact course of the law it constitutes a due process violation which offends against the rule of law.).

As far as the political cover-up, my best guess is that it came from the “Ohio Supreme Court”. Here is a rundown of five of the Judicial Officers that are connected with this case.

Warren County Court of Common Pleas, Chief Magistrate Brenda N. Dunlap;

• Defendant on three of the lawsuits
• Friend and colleague of Judge Michael E. Powell
• Illegally acting as a Magistrate, administrator and attorney for the estate at the same time.
• Illegally holding $150,000 of non-probate assets in her possession
• Conflict of Interest: Significant sums in legal fees owed by her client were to come at of the estate that she was illegally administrating.

Warren County Court of Common Pleas, Probate Judge Michael E. Powell;

• Probate Judge presiding over the estate
• Friend and colleague of Chief Magistrate Brenda N. Dunlap
• Appointed by Chief Justice Thomas J. Moyer to Supreme Court Committee with Justice Maureen O’Connor as Chair
• Appointed to Supreme Court of Ohio Commission on Technology and the Courts

Ohio Supreme Court, Part-time Judge David Sunderland;

• Appointed by Chief Justice Thomas J. Moyer as on assignment judge to the case that Chief Magistrate Brenda N. Dunlap and Judge Michael E. Powell were involved in
• Under Ohio Constitution illegally serving as Judge in this case

Ohio Supreme Court, Chief Justice Thomas J. Moyer (deceased, April 2, 2010);

• Appointed Judge Michael E. Powell to Supreme Court Committee
• Appointed Judge David Sunderland as on assignment judge to the case that Chief Magistrate Brenda N. Dunlap and Judge Michael E. Powell were involved in

Ohio Supreme Court, Justice Maureen O’Connor;

• Chairwoman of Supreme Court Committee that Judge Michael E. Powell Committee member served
• Now serving as Chief Justice Maureen O’Conner of Ohio Supreme Court

Besides allegations under the Federal Civil Rights Statutes; Title 18, U.S.C., Section 242, Deprivation of Rights under Color of Law and Title 18, U.S.C., Section 241, Conspiracy against Rights, there are many other violations as well. Obstructing Justice, Conspiracy to Defraud, Tampering with Evidence, Falsifying State and Federal Documents, Perjury, Using Sham Legal Process, and Interfering with Civil Rights just to name a few.

Exactly what kind of connections the Warren County Judges, Supreme Court Judges, the FBI Cincinnati office and the U.S. Attorneys Cincinnati office has yet to be detrmined?

Regardless of one’s status or position, when a public official elects to betray the public’s trust for personal gain, the very core of how and why our system of government operates is immediately and negatively impacted. Our Federal Government should gives priority to investigations involving the alleged breach of the public trust by government officials at any level.
